Terms and conditions of contract
- The Contractor: The contractor agrees to perform the work in a competent manner according to British Standard 3998 (1989) and in compliance with the specification and quotations contained in the estimate.
- Amendments: Any amendments to the contract must be made and agreed with Surrey tree surgeons Dave Ford Tree Care in writing, prior to the commencement of the work. Failure to do this will result in the full amount of the contract being invoiced.
- Value Added Tax: Where applicable, VAT will be charged at the current rate.
- Complaints: Complaints that may arise from the work performed under the contract and arising from the acceptance of the estimate must be made in writing within a period of seven days from the date of invoice, unless agreed in writing to the contrary.
- Tree Preservation Orders and Conservation Areas: The trees concerned in the contract may be in a Conservation Area or be subject to a Tree Preservation Order. If a planning application is required, Surrey tree surgeons Dave Ford Tree Care can apply on your behalf to the relevant authority.
- Tree Work Recommendations: Recommendations for tree work are made purely on tree health and/or aesthetic grounds. No liability whatsoever for owner or third party health and safety is accepted by the contractor. Owners of trees have a legal responsibility under The Owner and Occupiers Liability Act 1957 to ensure that their trees do not pose a threat to the public and/or other third parties such as visitors. Where the structural integrity of a tree, which is to be retained, is in question then the advice of an Arboricultural Consultant should be sought.
- Private Covenants/Easements/Licences: Investigation of private covenants will be the responsibility of the owner and no liability shall attach to the contractor for breach of any such covenant.
- Underground Services: A plan showing the exact location of underground pipes, wires or cables must be forwarded to Surrey tree surgeons Dave Ford Tree Care by the owner of the land, or his / her agent, prior to the formation of the contract. The contractor shall be under no liability for any damage caused as a result of work performed under the contract to such pipes, wires or cables, or for any damage of the property as a result of not having said information. The owner of the land or his / her agent, therefore, shall be solely liable for any such damage.
- Power Lines and Telephone Cables: Any charge for the removal of power lines or telephone cables will be the responsibility of the owner, unless otherwise agreed in writing with the contractor.
- Completion of Contract: The contractor will not be liable in damages or otherwise because of non-performance of the contract arising on account of adverse weather conditions, strikes, lockouts, war and civil commotion, or lack of adequately skilled labour due to causes beyond our control. Surrey tree surgeons Dave Ford Tree Care retains the right in such circumstances to cancel the contract in whole or in part. Completion dates shall be contingent upon weather conditions.
- Expiry of Quotation: Three months after the submission of the quotation the contractor reserves the right to withdraw and re-price work, unless otherwise agreed in writing on acceptance of instructions from the owner.
- Hidden Obstruction: Quotations for felling are based on the assumption of trees being free from metal, stone or other hidden obstructions. In the event of a tree being impossible to fell in the normal way, Surrey tree surgeons Dave Ford Tree Care reserve the right to re-quote accordingly.
- Stump Grinding: Stump grinding involves the removal of the tree stump but does not include the removal of lateral roots or stump chippings unless otherwise specified.
- Site Conditions: The contract price is based on the site conditions remaining unchanged and as existing at the time of the estimate preparation.
- Debris: All lengths measured are approximate.
- Insurance Cover: All work carried out by the contractor is covered by £5,000,000 Third Party and Public Liability Insurance for damage to persons or property that may result from the implementation of the contract.
- These conditions do not affect your statutory rights.
Should the above work specification meet your requirements, please complete and return the acceptance form provided. If your local authority states that a formal application is required to carry out the work Surrey tree Surgeons Dave Ford Tree Care will be happy to do this on your behalf free of charge. Fines of up to £20,000 are imposed on those who carry out work to trees without written council permission. This quotation is valid for 3 months from the above date.
